Helen Houghton claims ‘defamation win’ against Byron Clark but no court judgment is cited

Leader of the Conservative Party of New Zealand Helen Houghton has presented the outcome of her dispute with HarperCollins and book author Byron Clark as a personal legal victory on social media, but the published accounts describe a settlement and apology without identifying a court order finding of defamation.

A supplied screenshot of her 15 September post on X records the Conservative Party leader declaring: “A first win for the beginning of my law career was my own defamation case.”

The X post links to a Conservative Party website item about the public apology, which also promotes Houghton’s criticism of how media organisations presented Clark as an expert on extremism. That item identifies no court ruling.

The wording warrants scrutiny, but it does not claim a judge ruled in favour of Houghton.

In a supplied transcript to thisquality of her interview with Chris Lynch, around 7:39, Houghton said she could not discuss the actual settlement before adding: “I’m very happy with the settlement.”

Asked about financial compensation near the end of the interview, she again declined to disclose the terms: “I can’t discuss what was in the settlement, but I’m very happy.”

Houghton’s answer did not confirm whether money changed hands. But there is evidence it was a settlement, not a defamation court ruling.

The HarperCollins statement, dated 14 September, records her objection to appearing in the chapter “Women and the Alt Right” in Clark’s book, Fear: New Zealand’s Hostile Underworld of Extremists. It explains that she objected to the implication that she associated with, and shared the views of, far right extremists.

Its apology reads: “HarperCollins and Byron Clark never intended to defame Ms Houghton and apologise to her for hurt and distress caused.”

The statement does not admit any type of legal liability, identify a factual assertion being withdrawn or report that a court upheld Houghton’s interpretation of the chapter. It names no judge, judgment or damages award.

New Zealand’s courts distinguish settlement by agreement from a judicial determination. An agreed resolution can be binding and valuable to the parties without establishing that a court decided the underlying allegation was proved.

The settlement alone also does not establish that Houghton’s complaint lacked merit.

Lynch did introduce the outcome as a settlement.

A written report of the interview explicitly identified the defamation assessment as Houghton’s own view. His earlier piece used “forced into public apology” in its headline, while describing a settlement in the text.

The report had put questions to HarperCollins about payment, future amendments and whether it stood by the original editorial decision, but identified no court order.

Houghton also said future copies of the book would change, without specifying the amendments. The published apology does not supply those details.

The material reviewed does not disclose a court reference for any filed proceedings, any decision on liability or the precise changes agreed for future editions.
